Ex-FBI Leaders Charged Over 2023 Testimony
Prosecutors in the District of Columbia allege Nikki Floris and Bradley Benavides lied to the House Judiciary Committee regarding the handling of the Hunter Biden laptop investigation.

Each former FBI official faces a maximum of five years in federal prison if convicted. The Department of Justice filed perjury charges against Nikki Floris and Bradley Benavides on Friday. Both men and women were released the same morning after appearing before a federal magistrate. The indictments target false statements made to the House Judiciary Committee in 2023 about FBI probes involving Hunter Biden and his laptop.
US Attorney Jeanine Pirro stated that the pair undermined the institutions they served. She described the case as an instance where senior agents believed themselves above the law. The prosecution argues that Floris, a former intelligence division lead, denied any involvement in the Hunter Biden investigations. The affidavit claims she communicated with the case team for over a year. It further alleges she coordinated the bureau’s response to media reports about the laptop in real time.
Benavides, a former deputy assistant director for counterintelligence, testified that he learned about the laptop from a Wikipedia entry. The government asserts he was in constant communication about the device for days. A committee member stated that these answers influenced the inquiry by blocking follow-up interviews and subpoenas. The laptop was handed to the FBI in 2019 by a computer shop owner who said the former vice president’s son dropped it off and never returned.
Defense attorneys challenged the timing of the indictment. Floris’s lawyers argued the charges rest on political opinion rather than facts. They described her as a patriot with nearly 20 years of service. Benavides’s attorney, Ron Safer, asked the court to weigh the evidence against two lifetime public servants. They noted the government filed the case years after the testimony, on the eve of an election.
US Magistrate Judge Zia M. Faruqui questioned the material impact of the alleged lies. He granted a defense request for an evidentiary hearing to be held Tuesday. He called the rapid schedule rare for defendants released on personal recognizance. Faruqui observed that the charges were filed more than three years after the original testimony. He noted the defendants have strong backgrounds in law enforcement and need to clear their names quickly.
The laptop remains a point of political division. Republicans view it as evidence of corruption in the Biden family. Democrats characterize it as part of a partisan conspiracy. The case arrives as the FBI loses staff who worked on investigations involving President Donald Trump. Some former agents say they were dismissed for working on those probes or for lacking sufficient loyalty to the president.
Floris and Benavides are free while the case proceeds. The next step is the Tuesday hearing on the government’s evidence. The judge will determine if the statements were material to the congressional inquiry.
